Terms of Use

These Terms of Use (“Terms”) are an agreement between you and CrimeZone (“CrimeZone”, “we”, “us” or “our”). They govern your use of the CrimeZone iOS app, the website crimezone.app and related services (together, the “Service”). Please read them carefully. Questions can be sent to support@crimezone.app.

1. Acceptance of these Terms

By downloading, installing, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. We may change these Terms from time to time. We will post the updated Terms on this page and change the effective date above, and if a change is material we will take reasonable steps to let you know, for example through the app. Your continued use of the Service after the changes take effect means that you accept them.

2. Privacy Policy

Our Privacy Policy explains how we collect, use and share information when you use the Service. It forms part of these Terms.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 or under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms. By using the Service, you confirm that you are able to form a binding agreement and that your use of the Service complies with the laws that apply to you.

4. What CrimeZone provides

CrimeZone helps you explore an area using available recorded reports, estimates, mapped places, live radio and demonstrations. Information comes from public and third-party sources, and its availability, accuracy, freshness and coverage differ by source and location. Estimates, mapped-place density and fictional demo events are not recorded crime reports, and CrimeZone does not calculate a safety score or predict whether a place is safe. Live radio is third-party content that is not edited or verified by us and may be incomplete, inaccurate, delayed or disturbing. The Service is provided for general information only and is not legal, security or professional advice.

5. No emergency service

The Service is not an emergency service and must not be relied on in an emergency. SOS and Alerts are currently demonstrations: they do not call anyone, send messages or share your location. In an emergency, contact local emergency services. Do not use the Service in a way that distracts you while driving or otherwise puts you or others at risk, and do not use information from the Service to interfere with police, emergency or other public services, or to go to the scene of an incident.

6. Your account

You can use the Service without an account or sign in with Apple or Google. You are responsible for keeping access to your account secure and for activity that takes place under it. You can stop using the Service at any time and ask us to delete your account by contacting support@crimezone.app.

7. Prohibited activities

You agree not to:

• use the Service in violation of any law or regulation, or to commit, plan or evade responsibility for a crime;
• use the Service to stalk, harass, threaten, target or discriminate against any person or group;
• access, scrape, crawl or harvest data from the Service or our servers by any means other than the app or website as we provide them;
• overload, disrupt or interfere with the Service, its servers or networks, including by circumventing rate limits;
• copy, modify, decompile, disassemble or reverse-engineer the app, except to the extent the law expressly permits it;
• bypass or disable security features, access controls or Premium restrictions;
• sell, resell, sublicense or commercially exploit the Service or its content, or use it to build a competing product; or
• misrepresent your identity or your affiliation with CrimeZone or anyone else.

8. Intellectual property and licence

The Service, including the app, website, software, design, text, graphics and logos, and the selection and arrangement of its content, is owned by CrimeZone or its licensors and is protected by intellectual property laws. Data and content from third parties remain the property of their owners and are used under their licences and terms. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to download and use the app on Apple devices that you own or control, for your personal, non-commercial use. All rights not expressly granted to you are reserved.

9. Third-party content and services

The Service includes or links to maps, data, radio audio, websites and other content and services provided by third parties. We do not control them and are not responsible for their accuracy, availability or practices, and their inclusion does not mean that they endorse CrimeZone or that we endorse them. Your use of third-party content and services may be subject to their own terms. Third-party content may change or become unavailable at any time, and we may change, correct or remove content or features as coverage and permissions change.

10. Premium subscriptions and in-app purchases

• CrimeZone Premium is an optional auto-renewable subscription sold through the Apple App Store. The price, billing period and any free trial or introductory offer are shown before you confirm a purchase.
• Payment is charged to your Apple Account when you confirm the purchase. Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours before the current period ends.
• If your subscription includes a free trial, it becomes a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial is forfeited when you purchase a subscription.
• You can manage or cancel your subscription in iOS Settings under your name → Subscriptions. Deleting the app, signing out or deleting your account does not cancel a subscription.
• Purchases are processed by Apple, and refund requests are handled by Apple under its policies.
• We may change Premium features and, for future billing periods, prices, as permitted by the App Store and applicable law.

11. App Store terms

If you downloaded the app from the Apple App Store, you and we acknowledge that:

• these Terms are between you and CrimeZone only, not with Apple Inc. (“Apple”), and CrimeZone, not Apple, is solely responsible for the app and its content;
• your licence to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
• Apple has no obligation to provide any maintenance or support services for the app;
• if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app;
• Apple is not responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation;
• if a third party claims that the app or your possession and use of it infringes that third party’s intellectual property rights, CrimeZone, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim;
• you represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties;
• you must comply with any applicable third-party terms, such as your wireless data service agreement, when using the app; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.

12. Suspension and termination

We may suspend or end your access to all or part of the Service, with or without notice, if we reasonably believe that you have breached these Terms, if needed to protect the Service, our users or others, or if required by law. We may also change or discontinue the Service or any part of it. You may stop using the Service at any time. Sections that by their nature should survive termination, including sections 8 and 13 to 19, will survive.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment. We do not warrant that the Service or its information will be accurate, complete, current, reliable, uninterrupted, secure or error-free, or that using the Service will keep you safe.

14. Limitation of liability

To the maximum extent permitted by law, CrimeZone and its operators, affiliates and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or use, or for any personal injury or property damage arising from decisions made or actions taken based on the Service, whether based on contract, tort, negligence, strict liability or any other theory, even if advised of the possibility of such damages. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid for the Service in the 12 months before the claim arose or USD 50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived or limited by contract.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless CrimeZone and its operators, affiliates and licensors from any claims, losses, liabilities and expenses, including reasonable legal fees, arising from your misuse of the Service or your violation of these Terms or of the rights of any third party.

16. Copyright complaints

We respect intellectual property rights. If you believe that content in the Service infringes your copyright, send a notice to support@crimezone.app that includes: your contact details; a description of the copyrighted work; a description of the material you believe is infringing and where it appears in the Service; a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on its behalf; and your physical or electronic signature. We may remove or disable access to material that is the subject of a valid notice.

17. Disputes and governing law

If you have a concern or dispute about the Service, please contact us first at support@crimezone.app and give us at least 60 days to try to resolve it informally. These Terms are governed by the laws of the jurisdiction in which the operator of CrimeZone is established, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts that the law makes available to you.

18. Notices for California and New Jersey residents

California. Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. New Jersey. Where these Terms say that a provision applies “to the extent permitted by law” or similar, that provision does not apply to New Jersey residents to the extent it is prohibited by New Jersey law, and nothing in these Terms limits any remedies available to New Jersey residents under New Jersey law.

19. General terms

• Relationship. You and CrimeZone are independent parties. These Terms do not create any agency, partnership, joint venture or employment relationship.
• No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
• Severability. If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible or removed, and the remaining provisions will remain in full effect.
• Assignment. You may not assign or transfer these Terms without our consent. We may assign our rights and obligations under these Terms, including in connection with a sale, merger or transfer of CrimeZone or its assets.
• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. Only an updated version published by us can change them; statements by anyone acting on our behalf do not modify these Terms.
